These Terms of Service (“Terms”) are a binding agreement between you (“you”, “Customer”) and 深圳循证智康科技有限公司 (Shenzhen Evidence-Based Smart Health Technology Co., Ltd.) (“EBSH”, “we”, “us”), operator of the website at pmtahub.com and the EBSH · MIRS software tools (the “Service”). By creating an account, signing in, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
The Service is intended for businesses and professionals working on tobacco product regulatory submissions. By using it you represent that you are at least 18 years old, are using the Service for business or professional purposes, and have authority to bind the organization you represent. The Service does not sell, contain, or distribute tobacco or nicotine products.
We use passwordless, email “magic-link” sign-in. You are responsible for keeping access to your email account secure and for all activity under your account. Notify us promptly of any unauthorized use at pax@xzzktech.cn.
Subject to these Terms and your active plan, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service and to generate reports for your internal business and regulatory-submission purposes. You may include generated reports in your own PMTA/MRTPA submissions. You may not:
We offer per-tool annual subscriptions, an all-tools “Suite” subscription, and one-off single-report unlocks. Prices are shown at checkout. Card payments (USD) are processed by Stripe; where offered, Alipay/WeChat (RMB) are processed by a third-party aggregator. Subscriptions auto-renew annually until cancelled; you may cancel anytime from your dashboard, effective at the end of the current term. One-off unlocks are single-use digital entitlements. Taxes may apply. See the Refund Policy below.
The modeling tools run in your browser. Your modeling inputs (for example product parameters, HPHC concentrations, and PK inputs) are processed locally and are not transmitted to or stored by us. We process only account, billing, and non-sensitive usage data as described in the Privacy Policy. You are responsible for the accuracy of your inputs and for your use of any output.
The Service, including its software, models, methodology documentation, parameter libraries, and branding, is owned by EBSH or its licensors and is protected by law. Reports you generate from your own inputs are yours to use for your submissions; the underlying tools and templates remain ours.
The Service produces model-based supporting evidence. It is not legal, regulatory, medical, or scientific advice, and it does not guarantee that any submission will be accepted or authorized by the FDA, NMPA, or any authority. See the full Disclaimer below, which is incorporated into these Terms.
The Service is provided “as is” and “as available”, without warranties of any kind, whether express, implied, or statutory, including merchantability, fitness for a particular purpose, accuracy, and non-infringement, to the maximum extent permitted by law.
To the maximum extent permitted by law, EBSH and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or goodwill. Our total aggregate liability arising out of or relating to the Service will not exceed the amounts you paid to us for the Service in the twelve (12) months before the event giving rise to the claim.
You will indemnify and hold harmless EBSH from claims, damages, and expenses arising out of your use of the Service, your inputs or submissions, or your breach of these Terms.
We may suspend or terminate access for breach of these Terms or for risk to the Service. You may stop using the Service at any time. Sections that by their nature should survive termination (including IP, disclaimers, liability limits, and governing law) will survive.
We may update these Terms; material changes will be posted here with a new “Last updated” date and, where appropriate, notified by email. Continued use after changes means you accept them.
These Terms are governed by the laws of the People’s Republic of China, without regard to conflict-of-laws rules. The competent courts located in Shenzhen, Guangdong, China will have exclusive jurisdiction, and you consent to that venue.

Approved refunds are returned to the original payment method (Stripe for cards, or the original aggregator for Alipay/WeChat) within a typical 5–10 business days, subject to the processor’s timing. Upon refund of a subscription, the related access is revoked.

The modeling tools run entirely in your browser. We do not receive or store your modeling inputs — product formulas, HPHC concentrations, PK inputs, or the contents of the reports you generate. Those stay on your device. This is a core design choice.
To provide and secure the Service, authenticate you, process payments and provision access, respond to enquiries, comply with law, and improve the Service. We do not sell your personal information.
We use a single first-party, http-only session cookie for authentication and a local browser preference (language). We do not use third-party advertising cookies.
These providers process data under their own terms and our instructions.
We keep account, billing, and lead data while your account is active and as needed for legal, tax, and accounting purposes, then delete or anonymize it. You may request deletion (see below).
Depending on your location (including under GDPR and the CCPA/CPRA), you may have rights to access, correct, delete, or port your personal data, and to object to or restrict certain processing. To exercise these, email pax@xzzktech.cn. We will respond as required by applicable law.
We and our providers may process data in the United States and other countries. Where required, we rely on appropriate safeguards for cross-border transfers. Because your modeling inputs never leave your browser, they are not subject to such transfers.
We use reasonable technical and organizational measures (encryption in transit, access controls, signed tokens). No method is 100% secure; we cannot guarantee absolute security.
The Service is for business/professional users and is not directed to anyone under 18. We do not knowingly collect data from children.
For business customers that require one, a Data Processing Addendum (DPA) is available on request at pax@xzzktech.cn and is incorporated by reference where executed.

Supporting evidence, not a guarantee. EBSH · MIRS tools (InSilico-PK, ELCR Calculator, and PHIA Model) generate model-based supporting evidence intended to assist early regulatory decision-making and submission preparation. They do not constitute, and do not guarantee, authorization, clearance, or approval by the U.S. FDA, China’s NMPA, or any other authority.
Not professional advice. Output is provided for informational purposes and is not legal, regulatory, medical, toxicological, or scientific advice. You remain solely responsible for the design, content, accuracy, and submission of any regulatory application, and for independent verification of results.
Methodology and sources. The tools implement published, peer-reviewed methodologies and parameter values from public sources (for example FDA CTP guidance and memoranda, OEHHA, EPA IRIS, IARC, CORESTA, and published population-PK literature). Modeled estimates depend on the inputs you provide and on modeling assumptions, and may differ from empirical study results. Modeled evidence is typically combined with confirmatory study data in a weight-of-evidence submission.
No warranty. The tools are provided “as is” without warranty of any kind. To the maximum extent permitted by law, EBSH disclaims all liability arising from reliance on the Service or its output. Your use is governed by the Terms of Service above.
Not a tobacco/nicotine product. This Service is software for regulatory science. It does not sell, supply, promote, or contain tobacco or nicotine products.
